  • We recently had a client who filed a tax return a few years back.  The IRS contacted him two years later notifying him that he improperly filed his tax return and they had assessed him approximately 25,000 dollars in additional tax & an additional 11,000.00 in interest and penalties for a grand total of 36,000.00 dollars.  His deadline was approaching and he was getting very nervous.  We spoke over the phone for over an hour about his situation.  He was very skeptical about hiring our company to help him in this matter.  His wife was extremely upset at him for putting them in this situation and he just wanted the problem to go away.  He told us on numerous occasions that he was going to just refinance his home and pay the IRS the requested balance.  He finally agreed to let us do our investigation into his case and we were able to find out what happened.

His original tax preparer did not report a few of his stock sales and the IRS assessed him tax on an additional 100,000.00 dollars from stock sales.  They did not take into account the expenses he incurred when originally purchasing the stocks which is offset against the proceeds from the sale.  After preparing his amended tax return, we found that he did not owe the IRS anything.  In fact, he received monies from the IRS because he actually ended up with a loss on the sale of his stock for that year in addition to a loss he was able to carry forward to the next year.  We took a look at the other years which were prepared by the same tax preparer and found that similar issues were present in two other years.  We were able to amend three of his tax returns and the client actually received 5800.00 back from the IRS.

This man was a very intelligent person who just wanted his problem to go away and almost cost himself nearly 36,000.00 dollars because he wanted to handle the problem by himself.  He was going to write the IRS a check for the 36,000.00 because he believed he must have owed it if the IRS said so.  Let me tell you, the IRS has humans working on the files.  They are capable of making mistakes just like anyone else.  The joy in his voice is something that I will remember for a long time.  He came in to the office and bought lunch for the whole office to show his appreciation.

A situation like this is a prime example of why it is so important to have proper representation when dealing in IRS matters.  You think you are saving yourself money but the reality is that it takes years to know the exceptions and rules which regulate these issues.

 

  • One of our clients had failed to file their tax returns for a number of years.  They were told by their accountant and friends that they were not required to file tax returns for whatever reason.  They were wrong and the IRS assessed them a total of 23,000.00 in tax, penalties and interest on their investment income.  The client and her husband were elderly people who were living off of their social security for the most part. The husband was disabled, in a wheelchair and had serious medical issues which prevented him from being able to communicate with people.
You know what the IRS did?  They garnished 50 percent of their social security income.  They put a lien on their home and froze their bank account.  An IRS agent went to their home and harassed them on three separate occasions and was extremely nasty to the wife.  They were just about to write a check to the IRS to pay the balance when they called us.  We explained to them that they have rights and they retained our services.  She called us two weeks later and told us that the IRS agent was banging at their door and had demanded payment on the balance due.  This after we had already notified the IRS that we had been retained by the client. We instructed her to hand the phone to the IRS agent who showed up to their home.  We notified the agent that we had been retained by the client and to send all inquiries to us.  We instructed the agent to cease the harassment of our client immediately.  The clients were never harassed again.

We did an analysis on their IRS files and found that the IRS had in fact made a mistake when calculating the tax liability.  We requested they abate the interest and penalties in addition to erasing the tax assessment and that is exactly what they did.  This client almost cost themselves 23,000.00 because they were scared, did not want to deal with the problem anymore and were unsure about what their options were.  The IRS agent who was harassing them personally called us as well as the tax payer and apologized for the error and the harassment.
